Product Liability. If you ship product.
When a product causes injury or property damage downstream — to a retailer, end user, or third party — the legal trail leads back to whoever's name is on it. Product liability is how you make sure that's defensible.
What it is
Product Liability covers bodily injury and property damage arising out of your product after it's in the marketplace. Coverage typically lives inside a General Liability policy's Products-Completed Operations grant, but for product-heavy businesses we often build a dedicated tower with higher limits and tailored exclusions.
What it covers
Bodily injury claims
Injuries caused by a product defect, malfunction, or failure-to-warn.
Property damage claims
Damage to customer or third-party property caused by your product.
Defense costs
Legal fees defending against product-related lawsuits and recalls.
Vendor endorsements
Adding distributors and retailers (Amazon, Target, Whole Foods) as additional insureds.
Common gaps we catch
- Limits set to retailer minimums (often $2M) without modeling actual exposure
- Missing failure-to-warn or design defect coverage on imported goods
- No product recall coverage — first-party recall costs are not in GL
- Excluded ingredients or materials (CBD, THC, supplements) on standard forms
- International sales not endorsed, leaving non-US claims uncovered
